Good points, KC. Sitting and waiting for the telephone to ring, or an email to land, does not get business to walk in your door. Writing, speaking, schmoozing, putting people together by way of introduction, getting your face out there, joining and attending promising groups, is the way to increase your visibility, and the business development will follow from that. Approaching each and every step as success or failure depending on whether a new client is signed with a fat retainer, really misses the point that you have to sow a lot of seeds and that waiting for them to take root and grow takes time and patience!

Excellent article. You have to kiss a lot of frogs in order to develop legal business and a following of referral sources. This is true now, after the financial bloodbath of the last four years, more than at any other time I can remember during my now 35-year legal career here on the WestSide of Los Angeles. But, anybody who thinks that wherever they are, the rain will just keep falling and the phone will just keep ringing, has not been paying attention. I believe it is essential to the development of any lawyer of any vintage to continue to market, meet and develop new contacts and relationships, whether things eventually go back to some kind of 'normal' after this economy gets healthier - don't hold your breath - or whether this is the new 'normal.' It's not about fear; it's about survival.
I love that tale. I knew a couple whose final issue in their divorce was who got the Yogi Bear cup.

I learned very early in my practice not to demonize the prior attorney. It won't make you look like a hero. Should the client ask what went wrong, I think choosing a diplomatic and vague explanation for why things may have gone wrong is the best choice. I think part of this is attributable to upholding the camaraderie among attorneys and maintaining respect for our profession and the ethics to which we all subscribe.

I would add that your existing practice area skills will undoubtedly come in handy with the new practice. Previously a business litigator but now you're asked to learn trust administration? Guess what: your knowledge of personalities and propensities to settle in the negotiation setting will come in handy when testy trust beneficiaries start arguing over which sibling gets to have dad's seashell nightlight (true story).

It's unfortunate that highly educated people all over the world - with a spotlight on Greece during the past few months, but all over - find themselves with doctorate degrees and no job prospects. Part of the reason I chose to study law is the myth - which I believe - that lawyers never go hungry. We can learn a new area of law in days, hours, months. We don't need to go back to school to gain the ability to earn our keep when the practice area we know well doesn't fit the new client that walked in the door. That's a huge benefit.

Good points K.C. One of the challenging aspects of partnership is comparing our financial rewards to others. Is it fair? Will we let it impact how we interact with those who we think got too large a slice? I think your last bit of advice is key: starting an open-ended conversation vs. whining is definitely the way to go.
